Two Concepts of Causal Responsibility
ABSTRACT:
Recently popular amongst legal theorists and philosophers alike is a
singular notion of causal responsibility that rests on an agent¹s causal
contribution to an outcome rather than her causal impact on an outcome
(e.g. Goldman 1999, Moore 2009, Braham & van Hees 2012). The prime
motivating cases are collective scenarios where unilateral action is in a
sense impotent, cases that apparently otherwise yield responsibility voids.
Here I argue that, while the contribution account of causal responsibility
may have some appeal in tort law, as regards compensation for an outcome,
it is inadequate for criminal law, or, more fundamentally, it is inadequate
for grounding judgments of praise-/blame-worthiness. When it comes to moral
accountability, any causal condition should bear on what is really at
stake: not the outcome in itself but how the outcome reflects an agent¹s
choice deliberations. This means resurrecting an account of causal
responsibility based on causal impact, and it requires rethinking the
problem of responsibility voids.
