Calpurnius Flaccus Declamatio 2 and the Lex Iulia de adulteriis
Abstract:
This paper purports to explore the way in which adultery controversiae, mock legal exercises on an invented theme, are not as distinct from their real-world legal context as has previously been appreciated. Through a case study of the second century CE text, Calpurnius Flaccus Declamatio 2, Natus Aethiops (“the son who was born Ethiopian”), I examine the similarities between this so-called fictitious exercise and the law that was in place at the time, Augustus’ Lex Iulia de adulteriis (18 BCE). I argue that this controversia closely emulates the language of the Lex Iulia, and also the language that later jurists who commented on this law had used, in two key instances. I will then draw together some broader conclusions about adultery controversiae and their relationship with Roman law.
Kirsten has recently completed her Master of Philosophy in the Department of Classics and Ancient History at the University of Sydney, where she worked on the theme of adultery in the Latin rhetorical exercise of controversia and the way in which they are underpinned by a rich tapestry of laws and legal principles belonging to Augustus' Lex Iulia de adulteriis. This project was led under the supervisory team of Dr. Eleanor Cowan and Dr. Anne Rogerson.
