<b>Bona Fides<em> in Ancient and Modern Law</em><br>

<b>Abstract:</b><br>
This paper examines the legal concept of good faith (<em>bona fides</em>), which began life as a defence in Roman contract law and survives in many civilian and common law jurisdictions. Good faith implies an obligation on contracting parties to deal fairly
and honestly with each other. The layperson may justly ask what this adds to the obligations that one person would reasonably expect from any other. It also raises moral questions, above all: What role should someone's personal qualities play in the assessment
of his or her legal rights and obligations? The question was not as striking to the Romans, whose legal concept of good faith developed out of fides, the ancient social virtue of trust and reliability. Is that what it still means today? Is good faith a technical
rule with a lofty name, or does it carve out a space for virtue ethics in positive legal systems? Is it, in fact, a pretext for arbitrary legal rulemaking? What can Roman law and society teach us - or warn us - about trust and fair dealing in legal relations? This
paper posits good faith as an important element of the individualistic tendency in Roman law, not by encouraging autonomy or idiosyncrasy, but by measuring each actor by his personal qualities and assessing his legal rights and obligations by those criteria.<br>

<strong>Marco Paoletti</strong> studied history at Oxford and Cambridge, and law at Monash University. He is currently working on a doctoral thesis on Person and Individual in Roman Law at the University of Sydney.<br>
